Terms of Service

Social Surfboard is operated by LeadsGPS LLC ("we", "us"). When you use Social Surfboard, your agreement is with LeadsGPS LLC. By creating an account or continuing to use the service, you agree to these terms.

The service

Social Surfboard is an AI tool that helps businesses plan, create and manage social media marketing. It includes brand research, marketing strategies, SEO reports, AI-written posts, AI video, a content calendar and an AI assistant. You must be of legal age, and you must have authority to bind your business if you use the service for one.

Your account

Keep your login details confidential. You are responsible for activity under your account, and you must keep your information accurate.

Acceptable use

You must not misuse the service. This includes:

• breaking the law, committing fraud, or sending spam;
• infringing anyone's intellectual property or privacy;
• creating illegal content, deepfakes or impersonations of real people, hate speech, harassment, or sexual content involving minors;
• creating malware, or trying to jailbreak or get around the AI's safety controls;
• interfering with security, for example probing, scraping or spreading malware;
• reverse engineering, reselling or redistributing the service, or getting around plan limits.

AI content

You are responsible for what you ask the AI to create and how you use what it produces. You must have the rights to any material you provide. AI output can be inaccurate or incomplete. Check it before publishing, and don't rely on it as legal, financial, medical or other professional advice without qualified review. To the extent we have any rights in the output, you may use it for your business. We may remove or restrict content, refuse or filter outputs, and suspend accounts that break these terms.

Intellectual property

LeadsGPS LLC owns the service, including its software, documentation and branding. While your subscription is active, we grant you a limited, non-exclusive, non-transferable right to use the service within your plan's limits. You keep ownership of your content. You give us a limited license to host and process it only so we can provide the service.

Copyright complaints

If you believe content created with Social Surfboard infringes your rights, contact us with details. We will review the complaint and remove content where appropriate. Accounts that repeatedly infringe will be terminated.

Payments and subscriptions

Our order process is run by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer service questions about orders and handles returns. Payment, billing, tax, renewal and cancellation are covered by Paddle's Buyer Terms. Subscriptions renew automatically until you cancel. When you cancel, you keep access until the end of the period you paid for. See our Refund Policy.

Service level and warranties

We work to keep the service running well, but we don't guarantee it will be uninterrupted or error-free. To the fullest extent the law allows, the service is provided "as is", without implied warranties of merchantability or fitness for a particular purpose.

Liability

To the extent the law allows, our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits, data or goodwill. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence.

Indemnity

You will indemnify LeadsGPS LLC against claims that arise from your content, your unlawful use of the service, or your breach of these terms.

Suspension and termination

We may suspend or end your access for a material breach, non-payment, a security or fraud risk, or repeated or serious violations of these terms. When access ends, you can ask for an export of your data within 30 days. After that, we may delete it.

General

These terms are governed by the laws of the State of Florida, where LeadsGPS LLC is registered in the United States. You may not transfer your account without our consent. We may assign these terms as part of a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control. We may update these terms and will post the new date above.
